RELEASE, ACKNOWLEDGMENT AND
INDEMNITY AGREEMENT


I hereby acknowledge that I have read, understand and agree to comply with the provisions of this Release, Acknowledgment and Indemnity Agreement (“Agreement”) relating to hunting fishing, and other activities on the SANDSTONE MOUNTAIN RANCH property (the “Ranch Property”) located in LLANO County, Texas.  The SANDSTONE MOUNTAIN RANCH is an entity of and owned by Albert L. Anderson Family Limited Partnership.

I further acknowledge and understand that no warranty, either expressed or implied, is made by the SANDSTONE MOUNTAIN RANCH, its owners, affiliates or employees (collectively, the “Release Parties”) as to the condition of the Ranch Property, or any roads, buildings, gates or other improvements located thereon.  I understand that my presence and activities on the Ranch Property exposes both me and my guests, dependents and property to dangerous conditions, risks and hazards that exist on the Ranch Property and which could lead to injury, death, illness, disease or other damage to person or property, including but not limited to the following conditions: poisonous snakes, insects and spiders; blinds and tree stands, erosion and general condition of the land, both on and off roadways or gullies, creating rough, hazardous and dangerous driving and walking conditions; animals (both wild and domestic) that may be diseased and/or potentially dangerous; flowing and/or deep water; persons with firearms both on or off the Ranch Property; and the use of vehicles.  I hereby acknowledge that I have been warned about the existence of, and expressly assume all risk and responsibility with respect to, such dangers, risks and hazards.

In consideration of the right to enter the Ranch Property and conduct hunting or other activities thereon, I hereby unconditionally release and agree to protect, indemnify and hold harmless the Release Parties from and against any and all claims, demands, causes of action and damages, including attorney's fees, resulting from any accident, incident or occurrence arising out of, incidental to or in any way resulting from my presence on the Ranch Property or the presence of any other person (including, without limitation, any minor or dependent) permitted access to the Ranch Property as my guest or at my request, WHETHER OR NOT CAUSED BY THE NEGLIGENCE OR GROSS NEGLIGENCE OF ANY ONE OR MORE OF THE RELEASE PARTIES.  I hereby further unconditionally covenant and agree that I, my heirs, legal representatives, successors and assigns, will not make any claim or institute any suit or action at law or in equity against the Release Parties that is based upon any accident, incident or occurrence arising out of, incidental to or in any way resulting from, my presence on the Ranch Property or the presence of any other person (including, without limitation, any minor or dependent) permitted access to the Ranch Property as my guest or at my request.

I agree that any claims, actions or proceedings arising out of or attributable to my presence and activities on the Ranch Property shall be litigated in courts located in LLANO County, Texas.  Furthermore, I hereby submit to the jurisdiction of any local, state or federal court located in said county and waive any right I may have to transfer or change jurisdiction or venue of any such jurisdiction.

As used in this release, the terms, “I”, “my person” and “myself” include minors and dependents in my care while on the Ranch Property.

I acknowledge that I have read, understand and fully accept the terms and conditions of this Agreement and unconditionally and voluntarily accept same in consideration of the right to enter the Ranch Property and conduct hunting or other activities thereon.  Because of the high risk nature of this undertaking, the undersigned fully warrants that he/she has knowledge and/or experience in hunting and in the outdoors.  The Release Parties have relied upon this representation in allowing the undersigned to enter the Ranch Property.
